Former Xavier Musketeers basketball player Dez Wells settled his lawsuit against the university on Thursday. Wells and the university agreed to a settlement out of court. The terms of the settlement were not released.

Wells filed a lawsuit against the university a president Michael Graham, the lawsuit included 11 claims, of those 11 libel for injury to his reputation, sex discrimination, negligence and emotional distress were amongst them.

Xavier University dismissed Wells in 2012 after a female student alleged that Wells raped her. Wells to his credit has claimed that the sex was consensual since the allegations first emerged.

The incident happened after a game of ‘truth or dare’, evidently the dare was for Wells and the accuser to have sex. They did which by all accounts was consensual the entire time. The accuser took off her clothes, kissed Wells and gave him a lap dance in the process. The girl went to the hospital the next day where no signs of trauma were found.

A Hamilton County grand jury declined to indict Wells following a hearing of the evidence. Hamilton Country Prosecutor Joe Deters declined to indict Wells and believed his innocence the entire time. Deters told Xavier President Graham that the university should hold off on disciplining Wells until after the investigation, they did not.

Wells was kicked out of Xavier in 2012, kicked out without a meeting with the university, kicked out before the investigation was finished. Kicked out and branded a rapist, without any facts to prove just that.

Following his dismissal from the school Wells transferred to the University of Maryland where the NCAA waived his transfer rule so he could play immediately.

Xavier has received a black eye from this incident a few other sexual assaults that have occurred amongst the student body. Both the university and Wells look to move on from this.
